Generally and simply speaking, that is usually determined by the kind of kernel and logical architecture used. Modern Windows devices use the NT kernel for example. You could have a Windows like file system on a *nix box, or run Wine on Linux, but that wouldn't make it an NT system. Likewise you can run Cygwin on a Windows box, but you're still running Windows.
